著作権侵害の文脈での「海賊行為」って言葉は一般的だと思うけどなぁ

先日の「高校生が海賊行為について話してた - P2Pとかその辺のお話@はてな」というエントリへのはてブ

正直なところ、「海賊版行為」という言葉はほとんど聞いたことないです…*1

に限定していて、著作権侵害の文脈で使われるべき言葉は「海賊版行為」だ、というところなのでしょうけれど、「海賊行為」という言葉は多義的な言葉として著作権侵害の文脈でも広く使われています。文脈で意味が変わる、というところでしょうか。英語での表現でもいずれも"piracy"です。

日本での著作権にかかわる文脈での「海賊行為」という言葉は、おそらくは海外から入ってきたものを翻訳して定着したものだと思われるが、英語そのものが多義語であるために、日本でも多義語としてそのまま翻訳したというところなのかなぁと思っています。

ということで、「海賊行為と海賊版行為は違う」という指摘については*2「同じです」とご返答しておきます。

余談

一応、著作権にかかわる文脈ではしばしば「海賊行為」という言葉が用いられおり、今回の指摘でそうしたものまで「間違ってる」かのような見方をされてしまうのは拙いなぁということで反論してみました。☆もたくさんついてましたし。

紛らわしいから他の言葉にした方がいいのでは?というのであれば、少し考えてみます*3。ただ、最近、ソマリア沖の話題が頻繁に取り上げられていて、「海賊行為」という言葉と「肩にオウムを乗せている方の海賊」との概念的結合が活性化しており、もう一方の「著作権侵害の文脈での海賊」より先に想起されてしまった、という時期的なものなのかなと思うところもあります。

もちろん、別の解決策もあって、より著作権にかかわる文脈であることを示すキーワードをタイトルに加える、ということでもいらぬ誤解を避けられたかなとは思いますけどね。
